What Is NIL?

To put it simply, Name, Image, Likeness is the set of rules implemented to protect the image of college and high school student-athletes against misuse of their name or personal brand for commercial uses. For instance, if you are a great soccer player at school and took a photograph wearing an athletic brand. If that same brand started using the picture to promote its products without your permission, you can challenge the brand for violating the right of publicity.

The name, image, likeness rules grants you the right to control the use of your name, image, or likeness for commercial purposes and to receive fair compensation for its use. Being NIL-compliant allows student-athletes to maintain their eligibility, monetize their brand, secure opportunities, and avoid legal violations. However, before the changes in NIL, the NCAA restricted high school and collegiate athletes from profiting from their personal brands to maintain the amateur status of their athletes; however, schools and colleges capitalized on the opportunity. All this changed in the landmark Supreme Court ruling in 2021, which effectively blew up the practice of restricting student-athletes from earning through their brand image based on antitrust laws. In 2024, the NCAA agreed to make further changes in the name, image, likeness policy and pay damages worth $2.8 billion in compensation to current and former athletes who experienced financial losses due to its regulations, dating back to 2016.
